Course Description: In this module we will examine the principles of Contract Law: how contracts are formed; the terms of the contract and the enforceability of unfair terms; we consider the vitiating factors that affect the validity of contracts. We examine the principles concerning performance of contracts, frustration and breach of contract, and remedies for breach. We consider the key principles that regulate these issues and any relevant statutory provisions, and how they have been applied and interpreted by the courts. On successful completion of the module, students should be able to: Acquire and show an understanding of where relevant, critical evaluation of the rules and principles of the Law of Contract concerning: Formation of contracts Vitiating factors, for example mistake, misrepresentation. Contract terms, including the incorporation of terms, and enforceability of e.g. unfair terms and exemption clauses. Breach of contract and performance. Frustration of contracts. Remedies.
