Course Description: This course explores US constitutionalism in the context of the practice of other major democracies using the organizing themes of the structure of governance and the protection of rights. After introducing the philosophical and historical context of the creation of the US constitution, we explore in turn: the political role and jurisdiction of the Supreme Court and the scope of judicial review in the United States; the separation of powers and the grants of powers to the branches of the federal government;federalism, and the protection of individual and group rights. We will read excerpts from leading Supreme Court cases to illustrate principle constitutional doctrines. Each section is accompanied with comparative commentary or parallel treatment of the topic in another constitutional tradition, drawing mainly from Germany, France and the UK.
